The POSH Act was enacted in pursuance of the guidelines given by the Hon'ble Supreme Court of India in the case of Vishaka vs. State of Rajasthan, famously known as the vishaka guidelines. the POSH Act has been enacted to ensure protection of the fundamental rights guaranteed for women under the constitution of India. the same has been enacted keeping in mind that India is a signatory to Convention on the Elimination of  all forms of  Discrimination against Women (CEDAW) and has ratified the same as early as 1993.
