This act is called The sexual harassment of women at workplace ( prevention,prohibition and redressal ) Act 2013.

 

Its imperative for every organization in India to have relevant internal complaints committee ( ICC ) .  There are other mandated things as defined in the POSH act which every organisation is required to adhere to. The Sexual Harassment of Women at Workplace (Prevention,Prohibition and Redressal) Act, 2013 ("The Law") was made effective on 23rd April 2013 by way of publication in the Gazette of India.The Hon'ble Supreme Court of indian in Vishaka Judgment laid down the guidelines that required every employer to provide a mechanism to redress grievances pertaining to workplace sexual harassment and enforce the right to gender equality of working women.

Sexual harassment is considered as a violation of the fundamental right of a woman to equality as guaranteed under Articles 14 , 15 and 21 of the Constitution

Article 14 in The Constitution Of India 1949
14. Equality before law The State shall not deny to any person equality before the law or the equal protection of the laws within the territory of India Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth

Article 15 in The Constitution Of India 1949
15. Prohibition of discrimination on grounds of religion, race, caste, sex or place of birth
(1) The State shall not discriminate against any citizen on grounds only of religion, race, caste, sex, place of birth or any of them
(2) No citizen shall, on grounds only of religion, race, caste, sex, place of birth or any of them, be subject to any disability, liability, restriction or condition with regard to
(a) access to shops, public restaurants, hotels and palaces of public entertainment; or
(b) the use of wells, tanks, bathing ghats, roads and places of public resort maintained wholly or partly out of State funds or dedicated to the use of the general public
(3) Nothing in this article shall prevent the State from making any special provision for women and children
(4) Nothing in this article or in clause ( 2 ) of Article 29 shall prevent the State from making any special provision for the advancement of any socially and educationally backward classes of citizens or for the Scheduled Castes and the Scheduled Tribes

Article 21 reads as:

“No person shall be deprived of his life or personal liberty except according to a procedure established by law.”

Article 21 has been held to be the heart of the Constitution, the most organic and progressive provision in our living constitution.
