Legal Obligation of Employers

first and foremost obligation of any employer would be to ensure the well being and safety of all his employees during the course of their employment or otherwise. After the enactment of the POSH Act, the employer has been vested with a bundle of additional obligations and responsibilities. the act mandates the employer to constitute an internal complaints committee in the manner prescribed therein and to order inquiry into any complaint that is received. the employer has the obligation to receive the recommendations of the internal complaints committee and take action against the offender according to the service rules. the employer also has the obligation to maintain secrecy of the complaints received and inquiries made. chapter VI of the POSH Act enlists various duties of the employer like providing a safe environment, create awareness about punishments for harassment, conduct workshops, provide assistance to the victims, monitor the functions of the internal committee, etc.

 To provide a safe workplace for women, sensitize all employees on the consequences of committing sexual harassment, have an ICC and there by a proper Redressal process.
