Steps for conducting ICC meetings

The Complaints committee can take action based on the report of the complainant if the reported incident has taken place within the last 3 months. The time limit of the complaint can also be extended if there are circumstances which prevented the complaint from being filed within the stipulated 3 months’ time frame

Upon receiving the complaint the ICC has to verify the preliminary nature of the complaint.

The Complaints committee after investigating the allegations should make a recommendation on whether there is a prima facie substance in the complaint.

 ICC should avoid making any judgmental recommendation based on the initial enquiry The complainant as well as the accused needs to be given sufficient process as mentioned by law to allow or defend themselves within the ICC.

 

It is imperative for the ICC not to come to any judgment while conducting the enquiry.

Questions raised by the ICC to the complainant or the witness should not show any bias against the accused  or  the complainant

 

ICC has power to grant any relief  to the aggrieved women as may be prescribed under the prevention of sexual harassment act 2013 act this may include

  • Granting interim relief to the aggrieved woman.
  • Granting outstanding arrears of salary to be paid
  • Any other recommendation which the ICC maintained fit within the scope of the law
